1. The recipient of Mobile Financial Services (bKash Service) of bKash Limited (hereinafter referred to as 'bKash') will be known as 'bKash Customer' and only such Customer shall be the user of the Mobile Financial Services Account (bKash Account).
2. The transaction/activities of bKash Account will be carried out in accordance with the prevailing laws of Bangladesh, rules, regulations, guidelines, circulars and order/directives issued by Bangladesh Bank and other regulatory authority which are applicable to Mobile Financial Services. bKash Customer shall be obliged to abide by such rules, regulations, guidelines, circulars etc.
3. The bKash Account Number (which is the MSISDN of the relevant SIM card) shall have to be correctly quoted in all bKash related documents/forms, where applicable. bKash shall not be liable for any loss or damage suffered as a result of wrongly quoting the Account Number.
4. bKash shall not be liable for any incomplete transaction due to insufficient balance in Customer's bKash Account.
5. bKash Customer must ensure that the correct amount of Cash In/Cash Out/Payment etc. has been made to/from the correct bKash Account before leaving the counter. No subsequent complaints will be entertained.
6. Before each transaction using bKash Service, bKash Customer should confirm the accuracy of the recipient's details and, where applicable, should remain cautious regarding the recipient's bKash account number, amount of money, his/her PIN and transaction instruction. Only the Customer shall be personally and solely liable for any wrong input or instruction provided by the Customer while making any transaction or for any transaction in pursuance of any inducement or false representation or fraudulent activity. In any case, bKash shall not be responsible or liable to make any reversal of such funds.
7. bKash reserves the right to determine all fees and/or maintenance charges in relation to bKash Service from time to time and such fees or charges will be debited from the bKash Account.
8. bKash Customer shall be obliged to provide bKash with any information as required by bKash in accordance with Anti Money Laundering Act-2012, Anti-Terrorism Act- 2009 and any circular/guideline issued by Bangladesh Bank.
9. bKash shall maintain strict confidentiality in relation to information about the Customer Account and its transactions. However, bKash reserves the right to disclose/provide any information in relation to bKash Customer in any of the following circumstances:
10. bKash Customer must not, under any circumstances, share the PIN of his/her bKash Account with anyone and shall be solely and personally responsible for ensuring its maximum confidentiality and security. In case of any apprehension of breach of secrecy or misuse of the PIN, the bKash Customer must immediately change the PIN. bKash shall not be held liable for any fraud and/or loss borne by the Customer as a result of misuse of PIN or breach of PIN secrecy or privacy due to Customer's negligence or mistake. If mobile phone or SIM card is lost, bKash Customer shall immediately suspend his/her bKash Account by calling bKash Customer Center (16247) and contact bKash for further action.
11. bKash Customer shall always strictly refrain from carrying out any financial transaction related business using his/her bKash Account. bKash reserves the right to take any disciplinary or legal action(s) or any other action that bKash may deem fit including but not limited to suspension or cancellation or termination of the bKash Account without any prior notice for violating any terms and conditions of this Form, or committing fraud or attempting to commit fraud or for suspicious bKash transaction or for any complain against the bKash Customer or for security purpose or on any other ground that bKash deem reasonable. In such case, the decision of bKash is final and binding upon the bKash Customer.
12. bKash Customer shall always be bound to abide by all the instructions communicated to him/her through any medium by bKash from time to time. Any failure to comply with such instructions shall empower bKash to take any remedial or legal action(s), including suspension or cancellation of the Customer Account, against the Customer after proper investigation. In such case the decision of bKash will be deemed final and binding upon the Customer. bKash reserves the right to suspend the Customer Account pending the investigation. However, if the Customer is instructed to make any transaction or enter any specific number or share the PIN or any Account related information through SMS or phone call, bKash Customer must not follow such instructions without verifying with bKash.
13. bKash Customer shall be solely responsible for his/her SIM card containing bKash Account and for all issues related to SIM replacement. bKash shall not, in any case, take any responsibility in this regard
14. If the SIM card containing Customer Account is replaced, bKash shall suspend the activities of such Customer Account after receiving information regarding such SIM replacement from the relevant Mobile Network Operator (MNO). The activities of such bKash Account shall remain suspended for a minimum of 24 hours as per the direction of Bangladesh Bank.
15. bKash reserves the right to amend, addend, upgrade, change or modify the existing terms and conditions in any way at any time without giving any prior notice to the Customer.
16. bKash shall have the right to send promotional IVRs, voice calls or SMS to the Customer at any time in accordance to the regulations applicable to bKash.
17. If bKash Customer wants to close his/her bKash Account, before making application to close the Account, he/she must use the entire remaining balance in his/her Customer Account (nil balance) by only using any of the bKash services.
18. bKash reserves the right to decide the criteria or rate of interest to be given on the accumulated balance of Customer's bKash Account. If the bKash Customer is unwilling to take interest, he/she can stop getting interest by calling bKash helpline (16247).
19. bKash shall in no way be liable for any delay in launching the bKash account or providing any bKash service due to any unexpected or inevitable reason. bKash will make the best efforts to successfully provide bKash services without making any commitment.
20. bKash Customer may lodge any complaint related to any bKash service by visiting the bKash Center or bKash Care or by calling the bKash helpline (16247) or by sending e-mail at support@bkash.com. In order to resolve any dispute or complain regarding any bKash transaction of a bKash Customer, bKash reserves the right to conduct investigation, call for the complainant and/or alleged bKash Customer in the head office of bKash, suspend or cancel the bKash Account and take any other corrective or legal action as appropriate in view of bKash.
21. bKash shall not share (except for verification of information) or sell its Customer's personal data or transaction report to any third party. However, bKash may share the transaction behavior data to third parties for observing the Customer's transaction behavior in order to provide him/her with improved services or features and to make his/her experience safer and easier.
I hereby confirm that to be a Customer of bKash Limited's Mobile Financial Services, I have read and understood all rules, terms and conditions mentioned above relating to opening, maintaining and operating account and pledge to comply with them. All information and documents provided in this KYC form, according to my knowledge, are true, correct and complete and have not concealed any information and I am aware of the relevant provisions of the laws. Note: According to section 8(1) of Money Laundering Prevention Act, 2012, "No person shall knowingly provide false information in any manner regarding the source of fund or self-identity or the identity of an account holder or the beneficiary or nominee of an account". And as per section 8(2) of Money Laundering Prevention Act, 2012, "Any person who violates the provision of sub-section (1) shall be punished with imprisonment for a term not exceeding 3 (three) years or a fine not exceeding taka 50 (fifty) thousand or with both".
